Competitive Offer Limited Warranty
Property Solution Services LLC (“Company”) offers a Competitive Offer Limited Warranty (the “Warranty”) to provide homeowners with a fair opportunity to receive a competitive proposal for the sale of their property.
Scope of Warranty
The Company’s offers are based on multiple factors, including but not limited to:
(i) purchase price, and (ii) overall terms and conditions of the transaction.
Such terms may include, without limitation, flexibility in closing date, property condition (including as-is purchases), assistance with relocation, cleanout services, advance funds, coordination of alternative housing, payment of certain transaction-related costs, and resolution of liens or legal matters where applicable.
The Company acknowledges that offers in this market vary significantly in structure, and therefore the highest stated purchase price may not represent the most favorable overall offer.
“Beat Your Offer” Representation
Any statement that the Company may “beat” a competing offer shall mean that the Company will, in good faith, evaluate and attempt to present a materially more favorable overall offer, which may consist of a higher purchase price, improved terms, or a combination thereof, as determined by the Company based on the seller’s stated needs and priorities.
Conditions for Eligibility
This Warranty applies only where all of the following conditions are met:
- The competing offer must be current, bona fide, and made in good faith by a legitimate real estate purchaser
- The offer must be in writing and verifiable
- The offer must relate to the same property and reasonably comparable transaction structure
- The seller must provide sufficient documentation of the competing offer upon request
Limitations and Disclosures
- The Company does not guarantee that any competing offer will be matched or exceeded
- Offers that are determined to be not comparable, unrealistic, misleading, or contingent upon materially different terms may be excluded from consideration
- Any comparison of offers will take into account the totality of terms, including but not limited to contingencies, timelines, property condition requirements, closing certainty, fees, and transaction risk
- The Company reserves the right, in its sole and reasonable discretion, to determine whether and how a competing offer may be improved upon
- This Warranty does not constitute a binding obligation to purchase any property under any specific terms
Good Faith Statement
The Company makes this Warranty in good faith and for the purpose of encouraging transparency and informed decision-making by property owners. Sellers are encouraged to obtain multiple offers and evaluate all aspects of each proposal before making a decision.
No Agency Relationship
Nothing herein shall be construed as creating an agency, fiduciary, or advisory relationship. Sellers are encouraged to seek independent legal, financial, or real estate advice as needed.
